CARICOM Consumer Definition
Art. 184 of the Treaty of
Chaguaramas deals with the promotion of consumer interests.
A consumer is defined as a
person, (a) to whom goods or services are supplied or intended to be supplied
in the course of business carried on by a supplier or potential supplier; and
(b) who does not receive the goods or services in the course of a business
carried on by him.
What kind of person is not
defined, so it can be understood in the broadest sense, including natural as
well as legal persons. The consumer is defined by its counterpart, the
professional who is offering the goods in the course of his or her business. The consumer must act outside his business. So
any undertaking which only falls primarily outside his or her business is not
included. The consumer must act completely for private purpose.
